Abercrombie (ANF) Sues Surf Style Over Seagull Logo

Saying Surf Style is infringing on its "distinctive and famous" seagull logo, Abercrombie has filed a complaint against the company because it could cause "irreparable harm to the company's reputation by associating its image with products that are 'cheap, inexpensive and inferior in quality.'"

According to Abercrombie's, Surf Style has been using its seagull logo on a variety of its clothing and products. It seeks monetary damages and an order for Surf Style to destroy all infringing merchandise.

Michael Chesal, a partner at Peretz Chesal & Herrmann in Miami, who is representing Surf Style, said, "Seagulls are clearly associated with the types of goods Surf Style sells and its locations which are usually located near beaches. Abercrombie is trying to spread its net much larger than the law will allow."

Parameters of trademark law are a company can be found liable for infringement if its goods are likely to create confusion in the minds of consumers.

Abercrombie closed Friday at $58.42. down $0.70, or 1.18 percent.
