Amazon.com (AMZN) Sued Over Apple (AAPL) Trademark

In a move to stop Amazon.com (NASDAQ:AMZN) from allegedly improperly using its Apple's APP STORE (NASDAQ:AAPL) trademark, the company has sued the online retailer to refrain from using the image.

The lawsuit, filed in a California federal court late last week, said Amazon has improperly used Apple's APP STORE mark to solicit software developers throughout the United States.

Apple has applied to register the APP STORE trademark in the United States, a bid which Microsoft (NasdaqGS:MSFT - News) opposes. The matter is currently before a trademark trial and appeals board, according to the lawsuit.

"We've asked Amazon not to copy the APP STORE name because it will confuse and mislead customers," Apple spokeswoman Kristin Huguet said on Monday.

Amazon.com closed Monday at $164.52. up $2.70, or 1.67 percent. Apple closed at $339.30, up $8.63, or 2.61 percent.
